Massachusetts Bullying Bill Overview

Section 37O of chapter 71 of the general laws...

The Bulling bill was passed after two students in Western Massachusetts committed suicide after being bullied. The bill aims at ending bullying in schools across the state. It requires the schools to have a plan which recognizes "that certain students may be more vulnerable to becoming targets of bullying, harassment, or teasing based on actual or perceived differentiating characteristics, including but not limited to race, color, religion, ancestry, national origin, sex, socioeconomic status, academic status, gender identity or expression, physical appearance, sexual orientation, or mental, physical, developmental, or sensory disability, or by association with a person who has or is perceived to have one or more of these characteristics."

The bill includes bulling in the written, verbal or electronic expression (Cyber-bullying) or a physical act or gesture which causes the victim physical or emotional harm or harm to his/her property. It also addresses bullying that creates a hostile environment for the victim and disrupts the learning environment and/or "places the victim in reasonable fear of harm to himself."

Additionally, the plan requires that a safe environment be created for the vulnerable students and that the children be educated as to how prevent and respond to bullying.

Furthermore, the schools district will be required to maintain and provide statistical date on bullying incidents.
